I edited the sentence that said, "''Only'' two of the jurors were African-Americans" to take out the "only." Let's just give people the facts. Also edited out a line that said Maye "probably" didn't know the gun was stolen. How can we judge this? Let's just stick with what is verifiable.

Though that assumption that everyone dosn't read past "killed a cop" is a brilliant standing point, im afraid that despite all evidence, even ignorant dribble that the media could twist into a "killed a cop, hes guilty!", his house was illegally entered, he drew a gun he legally owned and got into a position that is undeniably in defence of his life and home (his daughters), and shot an officer...that no-one has even raised questions over it is a huge controversy. Also, how is this a "current event"? The shooting happened in 2001 and the execution has not been scheduled.

Controversy: Lack of Media?

Since I first heard about this several days ago from a libertarian blog, one of the biggest complaints I've heard has been the lack of mainstream media attention this case is getting. All three news articles spell the name "Cory", in conflict with the spelling provided by the State of Mississippi. The affidavits don't mention his name. When the court transcript appears, this should solve the problem. I did e-mail Radley Balko to see if he had insight into the proper spelling of the name and am awaiting a response.

Radley Balko responded to my e-mail with this blog posting [1]: "I emailed public defender Bob Evans, who confirmed with Maye himself that it is indeed "Cory." Considering they would have started the criminal trial with proper verification of the identity of the defendant, I'm going to revert the name back to Cory.

Sorry about the missing the sig line; I'm still learning how all this works. Please let me know if I mess anything else up.

Facial tic and controversy

Balko provided another line today [2] which seems potentially significant, but is somewhat subjective. As a political consultant (Maye likely has Tourette's Syndrome or something similar -- wife is a psychiatrist, I'll ask her), I'll verify that subjective stuff like this makes a big difference on voting day. I've both won and lost recent campaigns on less than this:

Maye's current attorney, public defender Bob Evans, tells me one reason Maye have come off as unsympathetic to the jury was that he has an odd facial mannerism. He apparently has a half smile -- Evans says some might call it a smirk -- when he speaks, even when he's talking about pretty important things, like saving his own life. Any defense attorney will tell you that a defendant's body language is immensely important, perhaps more important than what he actually says. Evans' description of Maye's quirky mannerism seems to fit with what Maye's trial attorney told me early on -- that two jurors told her after the trial they thought Maye was spoiled and disrespectful. And that that impression made them less likely to believe his testimony.

The best wording I can suggest at this moment is:

It is possible that the jury was influenced by a neurological disorder suffered by Maye.

I think it would be a good idea for whomever is challenging the factual accuracy of this article to come forth and explain what they take exception to. The early mistakes made by Radley Balko in his initial reporting of Mr. Maye's case have since been corrected. So . . . what gives?

Also, might it not be a good idea to have the picture of Ron Jones currently on the Officer Down Memorial Page with his section? Two concerns over Counsel section recently added.

1. "Since Jefferson Davis County has a majority of African-Americans, who might have made more sympathetic jurors, while Marion County is largely white, it may have been a mistake having the trial moved."

I'm not sure if that passage belongs in it's current form if we're listing facts only.


2. "Maye's appeal was filed in a timely fashion and is ongoing. Maye is now represented by Bob Evans, the original public defender in the case, who is preparing his appeal."

I thought that Maye's appeal has yet to be filed. The first sentence seems to indicate that it was filed yet the second sentence states that the appeal is being prepared.

Perhaps these passage need to be 'cleaned up' a bit?  :)

Air America Radio

I recall a legal issue between Air America Radio and Air America Phoenix, but can't find proper documentation at this time. My recollection is that AAR is the better known liberal radio network, while AAP pre-existed AAR. They (as I recall) came to loggerheads over the trademark when Badnarik protested the legitimacy (in court -- Maricopa County, AZ -- I flew in for the event) of the most recent presidential debates in Tempe, AZ. The key issue from the people who talked to me in the courtroom ante-chambers was that AAR (Kerry side) favored the war in Iraq while AAP (libertarian) opposed it. The lawyers speaking which I remember had ties to the Bush camp, mostly.

While not sure how that issue was ultimately resolved, it is clear in my memory that there are two Air Americas at play here, and the one linked on this wiki entry is improper. I can dig up more if necessary, but it seems that the Air America link needs to be dropped, barring additional insight of which I am not aware.
