== Fotos borradas en Wikimedia commons ==

Hola Patstuart.
Sé que llego tarde para hacer comentarios en defensa de dos fotos que fueron borradas a sugerencia tuya. Se trata de Image:JOSE_BUCHS.JPG y Image:CARME_VIANCE.jpg Se trata de dos actores antiguos espáñoles y las fotos fueron tomadas en la década de 1920. La razón para el borrado es que no se indica que la muerte del autor fuera anterior a 1938. El problema es que no se sabe quién es el autor (son anónimas) y fueron publicadas en España hace más de 80 años.
Mi pregunta es si resulta de aplicación lo previsto en la Ley Española de Propiedad Intelectual [http://noticias.juridicas.com/base_datos/Admin/rdleg1-1996.l1t3.html], en cuyo artículo 27 se dice que, cuando el autor sea desconocido, los derechos duran 70 años desde la publicación, en este caso, de la fotografía.
Lo pregunto sobre todo para saber qué hacer en el futuro con retratos anónimos de esa época.

Salut ! Thank you for your message. (I will write in English.) I have uploaded perhaps 100 images and posted them to pages on fr.Wikipédia & en.Wikipedia during the last six weeks. (I am adding public domain images of French composers. Approximately 66% of the images are from the Bibliothèque nationale de France website entitled Gallica.) I understand the categories for <u>article</u> pages (to which I always add if i see something missing), however I did not know or understand that there were Categories for <u>images</u>. I assumed a image search at Wikimédia Communs was searching label and image identification entered by users who download the images. - - Where does this Image Category belong? I do not see a field for entering Categories in the field entry boxes for Public Domain images and Art images which I use. - - Must I go back to the image and edit the information to add it after it is downloaded? - - Perhaps this Category field should be designed into the Wikimédia Commun templates so users like me will know that this is necessary! - - Thank you for your reply. Hola Patstuart. Sé que llego tarde para hacer comentarios en defensa de dos fotos que fueron borradas a sugerencia tuya. Se trata de Image:JOSE_BUCHS.JPG y Image:CARME_VIANCE.jpg Se trata de dos actores antiguos espáñoles y las fotos fueron tomadas en la década de 1920. La razón para el borrado es que no se indica que la muerte del autor fuera anterior a 1938. El problema es que no se sabe quién es el autor (son anónimas) y fueron publicadas en España hace más de 80 años. Mi pregunta es si resulta de aplicación lo previsto en la Ley Española de Propiedad Intelectual [1], en cuyo artículo 27 se dice que, cuando el autor sea desconocido, los derechos duran 70 años desde la publicación, en este caso, de la fotografía. Lo pregunto sobre todo para saber qué hacer en el futuro con retratos anónimos de esa época.
