== misattribution of gender comment ==

On 18th April 2023, when the Bench was hearing same-sex marriage, Solicitor General argued that in the Indian Legal System, gender depends on biological sex. D.Y. Chandrachud pointed out that it's not true. The comment is being misattributed to him. Whereas he was stating the judgement of Justice K. S. Radhakrishnan and A. K. Sikri in [[National Legal Services Authority v. Union of India]] case in 2014. Since 2014, in India, people have had the right to self-identify as male, female or third gender (non-binary). Justice Chandrachud joined the SC in 2016 only.

Because today's case is being highly followed, Justice Chandrachud's comment caught the media's attention. They misattributed it to him. But it has been part of the Indian Legal System since 2014. And numerous Habeas Corpus filings have repeatedly reiterated the same comment on gender. It's not a noteworthy incident. Notable cases

[edit]

I have removed a large section of text regarding Chandrachud's "notable cases". The declaration of whether a particular case is notable or not cannot be made simply by citing the case itself, but must arise from reliable secondary sources that have written about the cases, such as law texts, law journal articles, or reliable news coverage.
