Public Domain Images

Just last week I realized that the Image copyright tag {{Template:PD-IndiaGov|PD-IndiaGov]]}} is based on a wrong interpretation of the Right to Information Act and hence they will be deleted, The template of PD-IndiaGov gave such an impression that everything uploaded from the Government website was very much leagal. I had uploaded many of the images from the directories of NIC.IN, I am of the opinion that atleast as per "fair use" we can use them. For example pictures of war

It is really unfortunate that the template was kept alvie for all these days. Its should have been revoked through peer review

This file is NOT necessarily in the public domain in the United States because a non-simple image can only be in the public domain in the U.S.:

• if it entered the public domain in India prior to 1996 (i.e., the author died before 1941 for most works or it was published prior to 1941 for photographs - see Wikipedia:Non-U.S. copyrights), or
• when, after that date, its copyright term expires in accordance with U.S. law.

Information about the creation date and creator should be provided.

If the image is not in the public domain in the United States, in addition to the license tag for its status in India an appropriate fair use license and rationale should be provided, or the image should be proposed for deletion.

If the media is in the public domain in both India and the United States, it may be transferred to the Wikimedia Commons.

Note: If this image is in the public domain in the U.S., modify the end of the copyright tag from }} to |commons}}.
This will replace the preceding U.S. copyright notification with a nomination for this image to be moved to the Wikimedia Commons.

is the tag to use. However, note that even if such copyright has expired in India if it was published after 1923 in the United States and registered then it is still in copyright in the United States and thus cannot be used on Wikipedia (fair use aside). If the images have never been published in the United States then the term to think about is life of the author plus 70 years. So, if an image has been published in India prior to 1946, and never published in the United States, then the author needs to have died before 1936 for the image to be usable on Wikipedia. Indian Copyright Act

Please take a note of this when you will be back / active. There is no article on Indian Copyright Act. I think, this is one of the reasons which led to issues with the template PD-IndiaGov [(this is for deletion) do you know some one with knowledge in legal issues and can also help us in building this article. --Aravind Parvatikar 08:05, 2 February 2006 (UTC)
