Rey Joseph "RJ" P. Nieto also known as Thinking Pinoy is a pro-Duterte[1] Filipino blogger and journalist,[2] the writer of the weekly op-ed column Thinking Pinoy on Manila Bulletin, and the author of the popular political commentary blog site ThinkingPinoy.net.[3]

After expressing support for the Duterte administration and writing several blogs that criticized members of the Philippine Opposition, he was accused by the latter for allegedy spreading “state-sponsored” fake news against them.[4][5] His indictment for the criminal libel case filed against him by Opposition politician Antonio Trillanes has been criticized by free-speech advocates as an “anathema of free expression.”[6]

Work and Educational Background

Rey Joseph finished high school in 2002 at St. Mary's College of Baliuag. He attended the University of the Philippines Diliman majoring in Mathematics but later dropped from school in 2005.[citation needed]

He worked as a columnist reporter at the Sunstar Davao local newspaper in 2010.[7]

RJ Nieto served as a co-host for the political lampoon podcast and radio program Karambola sa DWIZ 882, together with Jonathan dela Cruz, Trixie Cruz Angeles, Conrad Banal and Larry Gadon from 2016 to 2020.[8] The podcast simultaneously broadcasts on Facebook Live, YouTube Live and to analog radio receivers.

Nieto was hired[9][10] in July 2017 by the Department of Foreign Affairs as its social media consultant and was tasked to be its "head of strategic communications for migrant workers' affairs". He reportedly resigned in November 2017, a week after attending a Senate hearing which discussed fake news.[11]

The Bases Conversion and Development Authority reportedly offered Nieto a consultancy post to help it promote its projects especially the major endeavours under the Duterte administration's Build! Build! Build! infrastructure program but the blogger declined the offer.[12]

RJ Nieto has his own weekly op-ed column on Manila Bulletin titled Thinking Pinoy, with the first article published on October 18, 2019. Nieto still writes on his column as of August 2021.[2]

Currently, Nieto has his own show on SMNI News, called Thinking Pinoy on SMNI (or TP on SMNI),[13] a weekday radio and tv program commentary on topics of national interest and political issues together with co-host Admar Villando. First guest on the first episode was former senator, Bongbong Marcos. The show faced mixed comments and eventually became a hit on the network.[citation needed]

Before TP on SMNI, Nieto first appeared as a co-host on the show Usaping Bayan with Mike Abe [14] on the same channel on September 2020.

Personal Life and Advocacies

RJ Nieto has been openly gay and has talked about it on his blog posts. He has also produced videos together with transgender vlogger Sass Rogando Sasot tackling gender issues along with showbiz and politics on their podcast KanTalk.[15] The duo have notably expressed support for the passing of the pro-LGBTQIA+ and anti-discrimination SOGIE Equality Bill into Law.[16][17][18]

According to an interview on the now-defunct Concept News Central, ThinkingPinoy.net started in November 2015.[20]

Despite impressions that ThinkingPinoy.net is a government-sponsored “pro-Duterte” blog,[21] the offiicial About page of the website disclaimed that its content “do not necessarily reflect the view of any particular political party.”[3]

The About page also claimed that RJ Nieto “started this hobby in mid-November, when he created the infographic in RapplerX. The infographic was shared over 20,000 times across several social media platforms.”[3]

Thr Facebook page https://Facebook.com/TheThinkingPinoy presented at the About page of ThimkingPinoy.net[3] which functions as an extension/mirror of the website has 1.6 million+ followers as of August 2021.[19]

Notable Blog Posts

2021

  • On July 28, 2021, a 2019 post of RJ Nieto about weightlifting athlete Hidilyn Diaz has resurfaced a few days after the latter won the first gold medal for the Philippines in 2020 Tokyo Olympics.[22] The post, telling Diaz that she could be court-martialed,[23] trended in 2019 with 14,000+ Facebook likes and 4,000+ shares.[24] Netizens who unearthed the blog post pointed out the irony that Diaz, also a military officer, was rather promoted instead of court-martialed, and that Nieto's post did not age well. Before Diaz won the historical championship, she was maliciously included in the “Oust-Duterte Plot Matrix” in 2019 by then-Presidential Spokesperson Salvador Panelo. Diaz denied the allegations of Panelo and Nieto in a social media post.[22]

Issues and Criticisms

Misinformation allegations

Nieto has been accused of spreading misinformation through his website and Facebook page.

2017

  • Donald Trump and Antonio Trillianes - in 2017, Nieto made a post where he alleged that US President Donald Trump called Senator Antonio Trillanes a "little narco" or a drug lord. The senator called the claims in the article "fake news" and has filed a libel case against Nieto for the post while the blogger claimed that the primary source for the post was Al Pedroche's column in Pilipino Star Ngayon. Pedroche has apologized for the column saying that the interaction between Trump and Trillanes did not take place.[25]
  • In June 2017, Nieto, in a blog post, allegedly accused photojournalist Jes Aznar of “endangering government troops during the Battle of Marawi by revealing positions to the public via videos posted online”.[26] Aznar denied Nieto's claim in a Facebook response post, saying that he posted the videos when the government troops he was embedded with were already out of the area, and that his video postings were fully sanctioned by the military.[27] Nieto was condemned by the National Union of Journalists of the Philippines (NUJP) for allegedly “endangering Aznar's life via threats and harassment from Nieto's followers”. Nieto insisted his claims and did not retract his statement.[28]
  • In November 2017, Nieto created a post misquoting Canadian Prime Minister Justin Trudeau as saying "...Theoretically, it is impossible to get (the garbage) back... even if it originally came from Canada" in reference to trash shipped to the Philippines from Canada. In fact, Trudeau's actual quote was "Even though it originally came from Canada, we had legal barriers and restrictions that prevented us from being able to take it back. Those regulations and those impediments have now been addressed, so it is now theoretically possible to get it back.",[29] which is the complete opposite of what Nieto posted.[30][31]

2018

  • On March 4, 2018, he cited a falsified 1979 psychiatric report attributed to the late Fr. Jaime Bulatao, SJ on former President Benigno Aquino III.[32] On March 7, The Ateneo de Manila University Department of Psychology condemned the posting and reiterated that the report was a fabrication.[33][34] On April 27, 2010, Bulatao had already categorically denied having written and signed the report.[35][36]

2019

  • On December 28, in his Manila Bulletin column and blog, Nieto claimed that Philippine mainstream media and journalists were spreading fake news for stating that an amendment to the United States Fiscal Year 2020 State and Foreign Operations Appropriations Bill included a prohibition on entry to the United States for foreign government officials that the U.S. Secretary of State had credible information to have been involved in the wrongful imprisonment of Senator Leila De Lima.[37] Philippine Presidential Spokesperson Salvador Panelo however confirmed on December 29 in a radio interview that he had spoken with Philippine Ambassador to the U.S. Jose Manuel "Babes" Romualdez the entry ban was true.[38] While the approved U.S. Appropriations Act of 2020,[39] signed on Dec. 20 by U.S. President Donald Trump does not itself expressly mention the ban, the act's accompanying explanatory statement[40] in the Division G section[41] states that U.S. Federal Government entities are directed to comply with the directives and instructions of the reports accompanying the State Department appropriation bills of both the House and Senate. This includes the U.S. Senate Committee Report 116-126 which states: "Prohibition on Entry.--The Secretary of State shall apply subsection (c) to foreign government officials about whom the Secretary has credible information have been involved in the wrongful imprisonment of:... ...(2) Senator Leila de Lima who was arrested in the Philippines in 2017."[42][43][44] On January 22, 2020, Senator Ronaldo "Bato" dela Rosa confirmed that his travel visa to the United States had indeed been canceled.[45]

2020

  • On January 18, 2020, Nieto in his blog claimed that Ayala Land was “only paying 22 per square meter monthly to University of the Philippines for the lease of land of U.P.–Ayala Land TechnoHub”, citing his “expertise as a former Mathematics major at said university” to get to this figure.[46] Office of the President of the Philippines then-spokesperson Salvador Panelo declared that he wanted to review the lease contract between Ayala Land and University of the Philippines after reading about it on Nieto's blog. Ayala Land issued a press release falsifying Nieto's claims, stating that they are bound to pay more than ₱10 billion for the lease of land owned by University of the Philippines and is currently paying ₱171 per square meter and not ₱22 as claimed by Nieto and cited by Panelo.[47][48]

  • On March 2, 2020, Nieto allegedly claimed in a reaction vlog that Senator Franklin Drilon “fell asleep for five to ten seconds” during a February 27, 2020 interview with CNN Philippines anchor Pinky Webb.[49] VERA Files released a fact-check to Nieto's claim, asserting that “Drilon was reading documents in front of him and was not sleeping”.[50] Pinky Webb herself has also defended Senator Drilon in a social media post, saying, "Here’s what happened. As I was laying the premise for my question, I saw Sen Drilon look down at the documents he had on the table. I did not see him fall asleep."[51] In a related note, Senator Drilon became infamously known as the “sleeping senator” after getting caught on video asleep during a Senate hearing session in August 23, 2017, [52] and has since became an internet meme targeted at him. Nieto himself retaliated at VERA Files, countering that the fact-check website has taken his statement out-of-context, and wrote, verbatim:

Vera Files, in the assailed article, directed the reader’s attention to the 02 March 2020 Thinking Pinoy Facebook Live Video entitled “FACT CHECK: DID SENATOR DRILON FALL ASLEEP IN A CNN PHILIPPINES INTERVIEW?”, where it quoted: “Nakatulog siya momentarily, mga a span of five, ten seconds. Ngayon, medyo nakakahiya nga ‘yon. Pero feeling ko, ano ‘yan, may sakit si Drilon. Baka, ano, narcoleptic, ewan ko. Medyo hindi normal ‘yon eh, kasi, immediately before atsaka immediately after nung pagtulog niya, dilat na dilat naman siya. Pero kahit na, nakakahiya pa rin.” (He fell asleep momentarily, for a span of five, ten seconds. Now, that’s indeed kind of embarrassing. But I feel like, Drilon is sick. Maybe narcoleptic, I don’t know. What happened is not normal, because immediately before and after he dozed off, his eyes were wide open. Nevertheless, that is still embarrassing.) Nieto uttered these words at the 2:55 mark, as shown in the link below:

https://www.facebook.com/TheThinkingPinoy/videos/3401184933231084/?t=175

Vera Files, however, conveniently omitted what Nieto said at the 4:18 mark, which was: “So ang tanong, ‘Nakatulog ba si Drilon o hindi? Well, judging from the video… ng CNN mismo, mukha ngang nakatulog.” (So the question “Did Drilon fall asleep or not? Well, judging from the CNN video itself, he really looks like he fell asleep.”)

[53] VERA Files has not responded to Nieto. It is also unclear why VERA Files, in the first place, tried to fact-check Nieto's personal opinion video which served as a reaction to a news (but is not a news video by itself), when their job as fact-checkers on Facebook is to fact-check actual news articles published by news outlets, as VERA Files themselves stated on their website:

Facebook has partnered with VERA Files, as well as Rappler, in its third-party fact-checking program launched in the Philippines Thursday. The program aims to help combat false news from spreading on Facebook. Third-party fact checkers like VERA Files will review news stories on Facebook, check their facts and rate their accuracy.

[54]

Defamation lawsuits

Nieto has faced two defamation cases in relation to the content published on his blog site. One of which led to an indictment, while none so far have resulted in conviction.

  • In 2017, blogger Maria Josephina Vergina "Jover" Laurio, the author of blog site Pinoy Ako Blog[55] that publishes content criticizing the Duterte administration, has accused RJ Nieto of “doxxing” her.[56] Ironically, former Senator Leila de Lima, who was also the former Secretary of Commission on Human Rights, has expressed suport for the libel case filed by Laurio, [57] while human rights advocates and free speech advocates have called libel cases an attack on human rights and free speech.[6] After attorney Nick Falcis published evidences in 2019 allegedly proving that Kris Aquino has been funding Laurio to attack Nieto and other bloggers expressing support for Duterte,[58] there are still no further updates about the status of the case as of August 2021.

  • In 2018, Nieto was indicted for libel over a post on his blog that allegedly claimed “U.S. President Donald Trump called former opposition senator Antonio Trillanes a narco (a slang for drug lord)”.[59] Nieto filed a not-guilty plea and refused to comment on the case, telling reporters, "Let's just wait for the trial."[60] This indictment was criticized by free-speech advocates as an attack on freedom of expression.[6] As of August 2021, there were no updates about the trial or the case.
