He is best known for his DUI arrest in December 2023, during which he was verbally abusive, homophobic, racially abusive and discriminatory toward a law enforcement officer. Both the statewide GOP and Rios’s local district have requested his resignation. He has issued an apology but has not resigned. Nico Rios is an American politician. He has served as a representative for the 23rd district in the North Dakota House of Representatives since 2022, alongside Scott Dyk.[1][2]

Arrest

On December 15, 2023, Rios was pulled over at around 11:30 p.m. after he failed to stay in his lane.[3] In a police report, he was noted as being "verbally abusive, homophobic, racially abusive and discriminatory" toward an officer.[4][5]

Rios was charged with driving under the influence and refusing to provide a chemical test.[5] His next court date is scheduled for January 4, and a pre-trial conference is scheduled for February 5.[3][6]
