As of December 2007, Richard L. Davis is one of two people currently on death row in the United States for a crime other than murder, the other being Patrick O. Kennedy. He and his girlfriend Melissa Ticer were convicted of repeatedly sexually assaulting a child from October 2004 to January 2005. Davis had a prior history of mental illness, according to his defense attorney who said "You don't have to kill him to stop him. He is a product of a cycle of sickness" [1].
His case may bear on the Supreme Court decision related to use of the death penalty for child rape [2] . The court is scheduled to hear arguments in the case in April 2008.[3]
