This image is subject to copyright, but I feel it is covered by United States fair-use laws because:

1. It is a low-resolution copy of a CD artwork;
2. It is a subject of discussion in the article.
3. It does not limit the copyright's owners to sell the CD in any way;
4. Copies could not be made to make illegal copies of the artwork or CD itself;
5. The image is significant because it was made by a renowned artist.

This image is of a cover of an audio recording, and the copyright for it is most likely owned by either the publisher of the work or the artist(s) which produced the recording or cover artwork in question.
