2008 California Proposition 8
The 2008 Limit on Marriage Amendment (or Limit on Marriage Constitutional Amendment) is an initiative to include a measure on the 2008 General Election that, if passed, would prohibit same sex marriage in California by amending the California State Constitution to include language that "only marriage between a man and a woman is valid or recognized in California".[1]
Background
If passed, the amendment would override the May 15, 2008 California Supreme Court ruling in In Re Marriage Cases, that had stricken down Proposition 22, the 2000 anti-gay marriage referendum, as violating the constitution.[2] The Constitution, as amended, would specifically reject any marriage that is not between a man and a woman.
During the initiative process, the amendment was assigned the number 07-0068.[3] The initiative is sponsored by protectmarriage.com and voteyesmarriage.com, which had both sponsored unsuccessful initiatives on the subject in prior years.[4] Among the individual sponsors is Gail Knight, the widow of Pete Knight (who sponsored Proposition 22).[3]
California Governor Arnold Schwarzenegger stated that although he has opposed and has vetoed legislative bills that would legalize same sex marriage in California, he is opposed to the initiative and other attempts to amend the state's constitution.[5] Schwarzenegger released the following statement May 15, 2008 regarding the ruling:
I respect the Court’s decision and as Governor, I will uphold its ruling. Also, as I have said in the past, I will not support an amendment to the constitution that would overturn this state Supreme Court ruling.”[6]
