- Hey, thanks for the Augustus McCrae article suggestion, Wronkiew. (As an aside: The table and image gallery is a "Kansas Territory" thing. It says that Obama is related to lots of plainsmen and women who hailed from that era and locale -- including one historical cattleman that author McMurtry (who, of course, has been awarded a list of prestigious honors as long as your lasso arm) based McCrae on. Then, in an ironic, Kevin-Bacon twist, we quotes the Chicago Sun Times' Scott Fornek's bit about how Obama's progenitor Maureen Duvall is also the progenitor of Robert Duvall -- who portrays McCrae. (Whatever! lol. But my point is that the illustration, while yes unfree, happens to best fit the text accompanying this particular entry in the template-table.... :^) Just tips me hat but then 〜on thought bows deeply … 07:10, 6 January 2009 (UTC)
- I see that in Lonesome Dove and in Augustus "Gus" McCrae it is being used to illustrate the look of a character from a book (not the movie that the image is taken from) - how does this do more than just illustrate the character. The first article already has this image with the character on it and the additional one is unneeded. For the second article, the article is about the book and not the miniseries. Use here falls into the same trap as under WP:NFC - unacceptable use - images - point 7 or 8. Using this image to discuss the portrayal of the character by Duvall in the miniseries is arguably fair-use but not using it to simply illustrate the character in a related work (the book). - Peripitus (Talk) 07:06, 6 January 2009 (UTC)
- I think it's the same McCrae, whether he's in the book or the TV mini-series. (Eg this image of Brosnan (File:Brosnan and Connery at Madame Tussauds.jpg) is used in the article James Bond along with a graphic image by Ian Fleming....) - In Lonesome Dove, I agree that the article should only have one image of the character. Robert Duvall in Lonesome Dove.jpg being the less valuable of the two images, it should be removed. A complete article on Augustus "Gus" McCrae will certainly discuss his appearance in the miniseries, so I still think it can be kept there. Wronkiew (talk) 07:18, 6 January 2009 (UTC)

- Indeed we do. If he holds the copyright he needs to assert that and certify to OTRS - we certainly don't assume he does without that. And as for Fair Use, it must be claimed properly or we delete.--Scott Mac (Doc) 23:51, 7 January 2009 (UTC)
- For what it's worth, it seems reasonable to me to assume the uploader is not the copyright holder (the uploader's username is Snowme, the source and author of the image are given as "BKNB", and no justification is given to link these two names or to show that the copyright has been formally transferred from BKNB to Snowme). If that's the case, then this image, as it is now, is going to have a hard time satisfying the non-free content criteria, in particular points 1 (since presumably the image is potentially replaceable by a freely licensed photograph), 3 (since three images of Mr. Kyle are being used in the article Benjaman Kyle), 4 (no evidence has been given that this image has been published outside Wikipedia), and 10 (the documentation of the source is sketchy at best, and there is no fair-use rationale).
