In an official document of the Defense Intelligence Agency, dated 1991, Álvaro Uribe appears in the number 82 of a list containing the names of the most important drug dealers listed in Colombia. Uribe is described there as collaborator of the Medellín Cartel and intimate friend of Pablo Escobar; He is also accused of possessing financial interests in companies engaged in drug trafficking and would have assisted the cartel with regard to extradition laws.[1][2] -> These accusations have been considered false and never proved. The presumption of innocence, sometimes referred to by the Latin expression ei incumbit probatio qui dicit, non qui negat (the burden of proof is on the one who declares, not on one who denies), is the principle that one is considered innocent unless proven guilty.
In many states, presumption of innocence is a legal right of the accused in a criminal trial, and it is an international human right under the UN's Universal Declaration of Human Rights, Article 11. Under the presumption of innocence, the legal burden of proof is thus on the prosecution, which must collect and present compelling evidence to the trier of fact. The trier of fact (a judge or a jury) is thus restrained and ordered by law to consider only actual evidence and testimony presented in court. The prosecution must, in most cases prove that the accused is guilty beyond reasonable doubt.   • The Universal Declaration of Human Rights, article 11, states: "Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence.".
  • The Convention for the Protection of Human Rights and Fundamental Freedoms of the Council of Europe says (art. 6.2): "Everyone charged with a criminal offence shall be presumed innocent until proved guilty according to law". This convention has been adopted by treaty and is binding on all Council of Europe members. Currently (and in any foreseeable expansion of the EU) every country member of the European Union is also member to the Council of Europe, so this stands for EU members as a matter of course. Nevertheless, this assertion is iterated verbatim in Article 48 of the Charter of Fundamental Rights of the European Union.
  • In Canada, section 11(d) of the Canadian Charter of Rights and Freedoms states: "Any person charged with an offence has the right to be presumed innocent until proven guilty according to law in a fair and public hearing by an independent and impartial tribunal".

Uribe and the peace talks with FARC

I've never been to any country in the Americas. But I have noticed the development in Colombia through various North-European medias. And for a very long time, ever since Colombia didn't host the 1986 Football Word Cup. Lately I watched a , in my opinion, high quality TV-documentary about the peace-talks between the new Colombian administration and FARC. But Uribe was (according to this documentary) next to furious over this. If the documentary I watched is correct, shouldn't we describe him as something like "extremely against peace with FARC" (or something in line with that) ? Or was he incorrectly described ? I'm sorry that I cannot say more about the documentary, but it was long and made by an US woman, who appeared to have good knowledge , and so appeared to have had for a long time.
