Midheaven Not Always Overhead at Equator

At the Earth's equator, it is the point on the ecliptic which is directly overhead from the observer; as the observer moves north or south from the Equator,
This cannot be correct because the ecliptic does not usually have a point overhead at the equator. The celestial equator does. Only when the overhead point is an equinox point does the ecliptic have a point overhead at the equator. At other times it passes north or south as does the sun when it is not an equinox.
