Makdessi decision
[edit]The Supreme Court handed down the decision in Makdessi yesterday, which obviously will recast the contents of this article. I will read it and make the changes when I have the chance, and hopefully also include some of the commentary on the decision. --Legis (talk - contribs) 14:05, 5 November 2015 (UTC)
The historical discussion in Makdessi' should be treated with some care, and might be worth contrasting with the account given in Meagher, Gummow & Lehane's Equity: Doctrine and Remedies (5th ed, 2015, LexisNexis) and of course the Andrews v ANZ decision. This is particularly so with the Court's treatment of the breach requirement.
