Name - Shire of Augusta Margaret River

It is the Shire’s opinion that the “Shire of Augusta Margaret River” is both the Shire’s legal and gazetted name. If the Shire’s name has been written elsewhere with a hyphen then this is incorrect and not its legal name.

I note the following in support of this: A. Under Schedule 9.3 item 4 of the Local Government Act 1995 it states: “(1)On the commencement day — (a)a former district becomes a district as if it had been declared to be a district under section 2.1; and (b)its name is to be derived from the name of the former municipality by omitting “Town of”, “City of” or “Shire of”, as the case requires, unless subclause (2) applies.” [italics added]

The Government Gazette of 23 June 1961 shows that the name of the Municipality under the Local Government Act 1960 was “Shire of Augusta Margaret River”. Therefore the name of the district is - Augusta Margaret River.

B. Section 2.4 of the Local Government Act 1995 provides the designation of a district and states at s2.4(5): “A district that is not designated a city of a town is to be designated a Shire”. Augusta Margaret River is not a city or a town under s2.4(3)or(4) and is therefore a “Shire”.

C. Under section 2.5(4) of the Local Government Act 1995 it states:

“(4)The corporate name of the local government is the combination of the district’s designation and name. Example: City of (name of district)”

Therefore the corporate and proper legal name of the local government in this case is: District designation (Shire) + name of district (Augusta Margaret River) = Shire of Augusta Margaret River
