- Delete. I really like the image, but it fails at least WP:NFCC#1 (No free equivalent) and WP:NFCC#8 (Contextual significance) because it is not even mentioned in the article. It could be replaced by a photo of the artist (since the article is about the artist not the art anyway). - I don't buy the fair use rationale. The cartoon could as easily be described. The cartoon is readily usable in the resolution we have, yet the article says the cartoonist has earned $50k from it - we 're surely, even if in only a small way - likely to deprive him of income. Whilst respecting the views of others, I'm shocked that we would think for any more than a minute that this is other than an egregious copyvio. Let me count the ways:
- 2. Respect for commercial opportunities. Non-free content is not used in a manner that is likely to replace the original market role of the original copyrighted media. We are giving the whole thing away for free.
- 8. Contextual significance. Non-free content is used only if its presence would significantly increase readers' understanding of the topic, and its omission would be detrimental to that understanding. How much less would we understand the article by describing it: "line drawing of two dogs, one sitting on an office chair in front of a computer, the other on the floor looking up. The caption is...". There is no part of the article that would suffer.
- Ah well. Only two ways, as it turns out. But either we have respect for our own policy (and others copyright) or we do not. Wanting the image simply is not enough. --Tagishsimon (talk) 18:53, 3 September 2009 (UTC)[reply]

- Keep. This is an iconic image, one that is notable enough to merit its own article. It's pretty well settled that an iconic image can be used in an article about that iconic image. With respect to Tagishimon's objections, I don't think either of them is valid. There's no market for using an image in an article about itself, as such use is nearly always fair use, which doesn't require a license. The image is absurdly widely available, at better resolutions, so our use doesn't make it materially more available to potential infringers. I also don't think the image can be replaced by text. For example, Tagishimon says that it is a "line drawing of two dogs", but that doesn't convey much. The images at Goofy and Pluto (Disney) are both drawings of dogs, and they look nothing like each other... nor do they look anything like the dogs in On the internet, nobody knows you're a dog. The current resolution seems to be reduced quality, and if anything, too small, as it's hard to make out what technique was used for the shading in the image. I think this does satisfy 10c, albeit onlyt barely, but wouldn't be opposed to improving the image page. — PyTom (talk) 13:05, 4 September 2009 (UTC)[reply]

He has earned the royalties from publishing his comic in magazines and news papers and selling posters and t-shirts, not from selling a glimps of the image to private users (what Wikipedia is doing). People are not going to print their own posters or t-shirts from our measly 0.1 megapixel image! - The permission (OTRS ticket 2009080610048158) refers only to use on Wikipedia, not to release under a CC license. However, as this image is clearly a rather old one, I doubt the webmaster of the source website is the copyright holder anyways. - I may have simply selected the wrong template when I uploaded the photo. I do have an e-mail from the webmaster giving permission for it to be used, which I forwarded to Wikimedia Commons, but I suppose if he's not the copyright holder then that doesn't matter.
