This is concerning. This photo is not in the public domain and should not be listed as such. It remains under copyright to Columbia Pictures, 1938, as does the film the photo represents.Oanabay04 (talk) 16:55, 13 May 2012 (UTC)[reply]
Please link to the Commons file. I can't find it. Healthy, Wealthy, and Dumb was properly registered for copyright in 1938[1] and renewed in 1966[2]. It is not public domain. -Nard (Hablemonos)(Let's talk) 03:37, 15 May 2012 (UTC)[reply]
A couple of things I've noticed... The photo is not on Commons, it is listed on Wikipedia. It is not a screenshot, it is a studio's publicity photo. Use rationales for each of the photo's present uses are listed separately on the File's WP page. And I am not sure if/how publicity photos can qualify for fair-use (even though I did look for - and was unable to find - the appropriate guideline for this case). I don't think 'Wikipedia is not the place for child pornography' is specifically listed at WP:NOT, but perhaps it should go without saying. This is a sexualised image of a child, which might well be illegal under the laws of my country and several others, even if it is a cartoon. The only article that uses it is already illustrated by a photograph of an adult, so this picture doesn't add any encyclopaedic value. This was deleted as a copyright violation from Commons due to freedom of panorama concerns. If installed in 1923 or later, the statue is copyrighted in the United States, so it needs to be deleted. There are other images, such as File:Sejong of Joseon.jpg, which show the same person, so fair use isn't applicable in the Hangul or Origin of hangul articles. The original han'gŭl form can be illustrated by using File:King Sejong statue inscription.jpg or any other image showing the same han'gŭl form. Fonts are not copyrightable in the United States, so a photo of the inscription is free in the United States.
