- The photograph is a family photograph that has been in possession of the family for over 70 years. I have scanned it from the original print. There is no indication of the photographer on the photograph. I am happy for it to be in the public domain.As far as I know it has never been published. It must have been taken in the 1920s and thus shoudl be well out of copyright in most jurisdictions. I don't know how to tag it properly. - The original upload is a self-pic that I once used as my profile picture on my personal user page, during my time as a more active member. I deleted my own user page, but I forgot to delete the photo. A new user then uploaded a new mugshot over my original file. It's right there in the revision history. - The image is sourced as "From Polish Wikipedia". But at pl:John Boyd Thacher, the image is a redlink and I don't speak Polish, but the reason given for deletion links to their licensing policy, so I'm assuming it's something along those lines. B (talk) 04:02, 13 July 2011 (UTC)[reply]

- Not necessarily. The date of creation doesn't determine the copyright - the date of publication does. If it was not published until 1924, it could be copyrighted. The Polish Wikipedia deleted the image for some reason ... and without an actual source, we have no basis on which to even confirm the authenticity of this image. --B (talk) 13:15, 13 July 2011 (UTC)[reply]

- Keep - the template states "In most cases" - this is not "most cases." The image is treated as seized Nazi assets and is considered PD in the United States - this was discussed somewhere (Ed can probably point you to the discussion) and the consensus was that these images are fine to use on en.wiki only. German copyright law is not relevant to images hosted on en.wiki, as the servers are located in the United States (which is why, for example, we cannot use paintings by Willy Stöwer, who died in 1931 - his works are PD in Germany, but are still protected by copyright in the US from the URAA). - I don't know if it's right for the uploader to !vote in these discussions, but if it's okay, I think it's obvious what I'd say. ;-) What Parsecboy says is correct. I don't remember where the discussion was (it wasn't Design 1047's FAC), but I have a bad feeling it was on the Commons' Village Pump with Carl Lindberg. - License could be correct -- it just says it is PD in the United States, not specifically a reason. A work published *anywhere* before 1923 is PD in the US. If this was taken from captured German material, and the copyright owner would be a government, then yes that is an exemption to the URAA restorations -- those works were not restored. German law only applies as much as the URAA allows it to. Secondly, if there is no actual photographer mentioned, copyright may expire in Germany as well 70 years after publication (and this was taken in 1939/1940 from the documentation, so this may well have become PD in Germany in 2011). That latter part is not relevant to the U.S. copyright status however -- if the URAA restored it, then it will remain copyrighted for some time, and if not, it's been PD for quite a long time. I have tagged a lot of files by L'Écolier (talk · contribs) and I have realy seen enough: Files uploaded by this user are copyvios.
Most likely, by the topic connection to José Martí International Airport, Cubana de Aviación and the city Havana and by his editing style I suspect this user is related to a big copyvio sockpuppet zoo that recently (2011/06 and 2011/01) flodded Commons with stolen photos and that was also active in the past (since 2007/01). --Martin H. Same as above: Ive seen enough, all files uploaded by DanishWolf (talk · contribs) are copyvios. Except the voice recordings which I assume beeing self-created files.
Following 2 1/2 years of hibernation DanishWolf, became active again and invaded Commons with a sockpuppet zoo and tons of copyyvio uploads. Note that DanishWolf is not Danish and his sockpuppets are not French, German, Italian or Polish as he claims on his userpages. Regretably I now must accept that his recent copyvio vandalism was not a short disruption of our project but that DanishWolf has a history of uploading stolen files and that a not to be taken lightly percentage of Havana related mediafiles is copyright infringement done by him and his assumed sockpuppet zoo.
