Maitland appears to have been first drawn to Gierke‘s work in his research on the legal history of persona ficta, but he soon became fascinated by Gierke‘s political theory of real entity. Maitland himself was also the key proponent of the real entity theory in Britain: in his late life, he published five papers in an attempt to substantiate the real entity theory with the local legal practice of England. 84 The real entity theory was seen as a liberation from the laissez-faire and individualist jurisprudence that represented by contemporary common law, and Maitland‘s argument was later taken up enthusiastically by the English political pluralists who were against the theory of state sovereignty.
